1. The Joaquim Card holders mentioned in the Terms & Conditions refer to the customers who successfully open and maintain qualified Joaquim account(s) with the Bank in mainland China (excluding Hongkong, Macau and Taiwan).
2. The Joaquim Cards are solely issued by the Bank to the Joaquim Platinum and Joaquim Gold customers.
3. The Joaquim Cards are issued solely for the purpose of identifying the distinguished status of the Customers and the Customers may identify themselves while enjoying specific privileges and benefits arranged by the Bank for the Customers. The Joaquim Cards do not have any banking card functions, nor can it be used as credit proof or be used directly in retail or banking transaction. The Joaquim Cards shall cease to be used when the Customers cease to be Joaquim Platinum or Gold customers. The Joaquim Cards are for the use of the Customers only and shall not be lent, transferred, mortgaged or be used for any other purpose.
4. The Customers shall present their Joaquim Cards to the affiliated merchandise suppliers and/or service providers (hereinafter referred to as "Merchants") when enjoying various privileges and benefits granted by the Bank. The Merchants are entitled to check the identity of the Customers. All detailed contents of the benefits and usage rules are jointly determined by the Bank and the Merchants and may change from time to time without prior notice to or consent from the Customers.
5. Notwithstanding the Customers with their Joaquim Cards may enjoy the privileges and benefits provided by the Merchants designated by the Bank, the Bank shall in no event be deemed to sell or recommend any related products or grant any relevant services to the Customers or provide any quality guarantees, assurance or other promises in any manner for such products or services from the Merchants. Whether to accept such products or services solely lies with the Customers' own judgment and decision. It is acknowledged that for any disputes arising from purchasing or using such products or services, Customers shall resolve the disputes directly with relevant Merchants.
6. The Bank is entitled to cancel, suspend or replace all/part of the privileges and benefits for the Joaquim Cards without prior notice, and the Bank shall not be liable for any responsibilities. The Customer shall not claim for any indemnity or compensation in any way against such cancellation, suspension or replacement.
7. Customers agree to follow the requirement of minimum deposit and investment balances specified by the Bank for enjoying various privileges and benefits granted by the Bank. If Customers are not in compliance with such requirement, the Bank at any time is entitled to declare the Joaquim Cards null and void, withdraw them and terminate the privileges granted to the Customers.
8. All privileges and benefits obtained by the Customers upon the Joaquim Cards shall not be converted into cash.
9. In case the Joaquim Cards are lost, Customers shall apply for re-issuance from the Bank and assume any consequential losses.
10. The Terms & Conditions are formulated and shall be interpreted by the Bank.
11. The Terms & Conditions are written in both Chinese and English. If there are any discrepancies between the two versions, the Chinese version shall prevail.
